About JDL

The following Terms and Conditions apply to all users of the Jewish Defense League website, http://www.jdl.org/ (herein referred to as “the Website”), which is owned and operated by Jewish Defense League, Inc. (herein referred to as “JDL”):

A. Every user accepts upon himself, in free will and consent, these Terms and Conditions, and agrees to be bound by these Terms and Conditions, to act pursuant to the Terms and Conditions stipulated herein, as they will be updated from time to time, and to obey them without any reservation. Anyone who does not agree to the Terms and Conditions should discontinue use of the Website and discontinue any contact with the Jewish Defense League.

B. These Terms and Conditions, the Privacy Policy, and the Legal Agreement form one complete agreement. The Terms and Conditions and Privacy Policy expand on and clarify portions of the Legal Agreement. If the terms of any one of the documents conflict with the terms of any other, the Legal Agreement shall prevail.

C. All the rights, including the intellectual property (IP) rights (copyrights, trademarks and servicemarks, trade names, and any other intellectual property, registered and non-registered) found on the Website, are owned exclusively by JDL and shall be the exclusive property of JDL, unless otherwise noted by JDL on the Website. The following limited, non-exhaustive list represents some prominent examples of JDL IP: (1) “Jewish Defense League” and JDL’s “Fist and Star Logo” are examples of registered ® servicemarks of JDL; (2) “The Five Principles of the Jewish Defense League” is an example of  copyrighted © JDL text; (3) “Jewish Defender” is an example of a JDL  trademark ™. No other person or entity shall use any of the rights without explicit written authorization from JDL, except as specified in the next paragraph below.

D. Those individuals designated as JDL Leaders (as defined by the Legal Agreement) are granted limited, royalty-free, revocable intellectual property license to JDL intellectual property (IP), as required to establish and promote their chapters and regional/national units (collectively referred to as a “JDL Authorized Entity”/“JAE(s)“). JDL Leaders are expected to use the JDL IP license responsibly - for the promotion of their JAEs - and to not compete generally with products or services offered by JDL. In the unlikely event that JDL determines that a product or service bearing JDL IP offered by a JAE competes generally and unacceptably with a JDL product (i.e. outside of a JAE’s established state, regional or national boundaries), JDL will inform the JDL Leader of the concern and make reasonable attempts to resolve the issue before revoking the JDL Leader’s IP license. If a JDL Leader resigns as a member, is an inactive member, is demoted, or has his or her membership terminated, his or her JDL IP license shall also be revoked. Notice of license revocation will be sent to the JDL Leader to his or her email address on file. In the event that a JDL Authorized Entity is deauthorized, disbanded or otherwise non-functioning, the entity shall no longer be authorized to use JDL intellectual property, unless and until the JDL Authorized Entity is reinstated by JDL and is under the leadership of a designated JDL Leader.

E. Although JDL exercises control over its JAEs through administrative directives and certification of them as designated entities, JDL shall not be held responsible for the independent choices made by JAEs, which are largely autonomous. JDL disclaims liability for all actions taken by JAEs that are not expressly authorized or recommended by JDL in writing. JDL further disclaims liability for all technological choices made by JAEs that are not explicitly authorized or recommended by JDL in writing. If you have an issue with an action of a JAE, you should contact that particular entity directly.

F. The Website and the intellectual property of the Jewish Defense League are owned by Jewish Defense League, Inc, a New York corporation. The content on the Website is for informational purposes only. It represents the views of its owner and is not necessarily representative of the views of associated corporations, other legal entities or individuals. The political views expressed on the Website are for informational and educational purposes only and should not be construed as attempts by the parent corporation to influence legislation or the outcome of any campaign for public office.

G. Prices and details of products and services posted the Website are subject to change without notice. All products and services are subject to availability and JDL gives no guarantee in this regard.

H. The Website is for non-commercial, personal or charitable use only. Portions of the Website may be used in commercial products if written permission is obtained by JDL headquarters. In the event that you use any of the services contained on this website for commercial use, JDL shall be entitled to charge you at its rates from time to time in respect of such commercial use.

I. JDL reserves the right to change the Terms and Conditions at any time by posting changes to it on the Website. It is your responsibility to review this page to ensure that you are aware of the latest terms and conditions. Your use of the Website after a change has been posted to the Terms and Conditions will be deemed to signify your acceptance of the changes.

J. While JDL has taken care in the preparation of the content and coding of the Website, the Website and the information, names, images, pictures, logos, icons regarding or relating to JDL, or the products and services of JDL, are provided on an ‘as is’ basis without any representation or endorsement being made and without any warranty of any kind, whether express or implied, including but not limited to, any implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the extent permitted by law, all such terms and warranties are hereby excluded. In no event will JDL or any related entity be liable, whether in contract or tort (including negligence or breach of statutory duty), for any losses sustained and arising out of or in connection with use of the Website including, without limitation, loss of profits, loss of data or loss of goodwill (in all these cases whether direct or indirect) nor any indirect, economic, consequential or special loss.

K. While JDL has taken care in the preparation of the content and coding of the Website, JDL does not represent that the information contained in this website is accurate, comprehensive, verified or complete, and shall accept no liability for the accuracy or completeness of the information contained in this website or for any reliance placed by any person on the information. Furthermore, JDL does not warrant that the functions or materials accessible from or contained in the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are virus or bug free or represent the full functionality, accuracy, or reliability of the materials.

L. If any of these Terms and Conditions (or any terms and conditions relating to a product or service referred to in the Website) should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which such terms and conditions are intended to be effective, then to the extent of such illegality, invalidity or unenforceability, and in relation to such state or country only, such terms or condition shall be deleted and severed from the rest of the relevant terms and conditions and the remaining terms and conditions shall survive, remain in full force and effect, and continue to be binding and enforceable.

M. Any controversy involving the interpretation or enforcement of the Terms and Conditions shall be settled by arbitration administered by the American Arbitration Association in Los Angeles, California as a last resort.
